Collaborative divorce is a way to resolve disputes between the parties by removing the disputed matter from the adversarial courtroom setting and treating the process as a way to problem solve toward an amicable solution and to create a "win-win" situation for all. As part of this process, each party retains an attorney whose job it is to help them make a good faith effort to cooperatively settle the dispute. The parties agree to honestly and openly disclose all documents and information relating to the issues. No one may go to court.

However, if the collaborative process breaks down, and the parties go to court, then each party's collaborative lawyer is not permitted to represent that party in the litigation.
